婚姻綠卡-沒送AP後來想送可以嗎? - 移民

這是我身邊一個朋友的例子

因為知道我最近在幫我太太辦跑來問我

1. 他去年11月送130跟485, 有加765,但是以為綠卡拿到前不會旅行就沒有送131,

但是現在後悔了,她跟先生今年暑假想要去旅行,但是怕綠卡還沒有下來,

其實我覺得很有可能到時候就能下來了,但是她想要辦辦看,辦個安心也好

我這幾天看的心得是131只要485在pending都能送.所以現在送應該不是問題?

但是看起來只要附上當初的797證明有付了485的費用也不用再付131的filing fee對嗎?


2. 據我的了解131的原始用意是用在緊急的旅行需要,但是實際上很多人還是拿來旅遊?

我查到的規定是:

USCIS will expedite an application, including an application for a travel
document, Form I-131, in certain situations, which may include:

Severe financial loss to company or person;

Emergency situations;

Humanitarian reasons;

Nonprofit organization whose request is in furtherance of the cultural and
social interests of the United States;

Department of Defense or National Interest Situation

USCIS error; or Compelling interest of USCIS.

老實說勉強可以說旅遊可以是"人道原因?"但是其實我也知道根本不符合

USCIS有任何給AP但是不是因為是"緊急旅行"的規定嗎?

還是反正就是灰色地帶?要拿AP出去玩的理由自己掰,回來自己小心?

3. 這位朋友原本是J status,但是老早就過期了,我也沒有問太多,但是據我了解

她如果在拿到綠卡錢沒有拿到AP離境的話是不是也算旅卡的申請自動放棄?

據我看131的說明答案應該是肯定的,但是我還是想要確定一下
