持F1可以和h1配偶一起送485嗎? - 移民

補充一下,F1送485時,其實並沒有真的失效,法律規定在一個模糊地帶
如果是拿AP再入境,F1就真的失效了,而F1在遞交485後也只能使用AP入境

F-1 students who have filed Form I-485, adjustment of status to permanent
residency, should inform International Student & Faculty Services. Filing
Form I-485 notifies the United States Citizenship and Immigration Services (
USCIS) of your desire to change to permanent residency and will affect your
“non-immigrant” intent. During the period of time that the
I-485 is pending, you will be a pending Adjustment of Status (AOS) applicant
and there is some question about whether or not you may also maintain your
F-1 student status. Since this is not a clearly defined area, you should
discuss the issue with your attorney. If you do decide to maintain your F-1
student status while the AOS is pending, you will need to follow F-1
regulations regarding maintaining status which includes full-time
registration during the academic year.

Once you file Form I-485 for adjustment of status, our office must terminate
your F-1 record in the Student Exchange Visitor Information System unless
you register full-time and otherwise maintain your F-1 student status. If
you decide not to maintain your F-1 student status, our office must
terminate your F-1 record in SEVIS. We will provide you with a printed
version of the termination which will show the termination reason as: “
otherwise failing to maintain status: I-485 adjustment of status pending”.

If you choose to maintain your F-1 status and register full-time, we will
continue to update your F-1 record in SEVIS until you can show proof of the
I-551 stamp or your green card. Once we have evidence that the USCIS has
approved your application for adjustment of status, we will terminate your F
-1 SEVIS record to reflect the change of status approval. If you have
questions about your decision whether to maintain full-time registration
